Attorney's Corner
The Department of Labor announced the implementation of the of the two backlog
reduction centers located in Philadelphia and Dallas. The backlog reduction
centers will permit the Department of Labor to adjudicate labor certifications
filed with the State Workforce Agencies known as SWAS.
Under the backlog reduction center, the SWAS will mail unopened cases filed
with the state agency prior to 2003. The first shipment will occur no later
than December 31, 2004 and the second shipment will occur no later than March 21, 2005.
The backlog reduction center will adjudicate cases on a first come,
first serve basis. It is believed that with the implementation of the
backlog reduction centers and the soon to be implemented PERM regulations,
the Department of Labor should be able to reduce the backlog quickly and
adjudicate labor certifications in a matter of months, as opposed to years.
